Administrative regulations of the Ministry of Internal Affairs of the Russian Federation for conducting exams for the right to drive vehicles and issuing driver's licenses. How to pass on a car license the first time

From now on, drivers are waiting for major changes in relation to passing exams for obtaining a driver's license. In particular, it will be possible to pass exams only after studying in driving schools, without the possibility of self-training. In addition, it will be possible to take the exam not only at the place of registration or temporary residence, but also where the training is carried out. It should also be noted that driving training and the exam itself will be divided into two parts.

These innovations are spelled out in the draft government decree, which has been expected for a long time. These expectations are related to the fact that new law about security traffic introduces amendments coming from November, providing for the presence of new categories and subcategories. However, for its implementation, a number of by-laws are needed, and the first of them is the Rules for passing exams for the right to drive and issue driver's licenses.

The main innovation is the fact that the exams will have to be done twice. Accordingly, the training itself will also be carried out in two stages.

In practice, this scheme will look like this: first, the student enrolls in a driving school and takes a theoretical course along with practical driving lessons in a closed area. Thanks to this stage, the student develops the initial skills of driving a vehicle.

After completing this stage, the student, after which he is issued an intermediate certification. Upon receipt, the student is sent to the traffic police, where he takes an exam on initial driving skills. Moreover, this exam should consist of two parts - theoretical and practical.

The theory, as before, is rented according to established tickets, however, the delivery procedure is carried out electronically. The rules of exercises for passing the practical part of the exam have not yet been approved.

After the student successfully passes the exam, he is given an examination paper, on which a mark of passing is put with the examiner's signature. This sheet gives the student the right to admission to training in real road conditions.

Thus, until the receipt of the examination sheet, the student is not allowed to drive a car on public roads. After passing the preliminary exam and obtaining a "permit", the student continues his studies, after which he passes the last stage of the exam - the city - to the traffic police. Only by passing it successfully, he can become the owner of a driver's license.

In the event that a candidate for obtaining a driver's license failed to pass the first part of the exam, and it does not matter - the theoretical part or driving on the site, he can retake it no earlier than seven days after the first attempt. At the same time, at this stage, the number of attempts to pass is not limited.

However, when passing the city driving test, the number of attempts is limited to only three, which are also scheduled after seven days. If the student fails to pass the exam on the third attempt, the next exam is scheduled 30 days after the failed third attempt.

It should be noted that when passing the exam, students will have more opportunities. So, if until today the exam had to be taken in any traffic police department at the place of registration of a citizen (it doesn’t matter whether it is permanent or temporary), now the student will be able to take the exam at the location of the driving school in which he is trained. With this innovation, drivers' candidates will have more choice in terms of driving schools.

For a long time during the development of a new project, the question of how best to organize the exams remained open. The first way out was the construction of sites for taking exams in the traffic police with the allocation of a larger number of vehicles equipped for taking exams. However, this plan had to be abandoned due to the fact that not all regions have a sufficient number of students who pass exams for obtaining a driver's license. For this reason, the construction of sites will simply turn out to be unprofitable and will lead to enormous expenditures of budget funds, which, as always, are not enough.

The second option was to use the existing sites and technical base of driving schools for exams. However, this option also caused significant problems due to the fact that driving schools did not want to provide sites and their own cars for taking exams from “foreign” students.

For this reason new version The project provides for the possibility of conducting the first stage of the exam in theoretical and practical parts on the basis of driving schools. However, this is possible only if the material and technical base of the driving school meets the necessary requirements. Among them, the availability of tickets in electronic form, as well as a site that meets the requirements of the traffic police. At the same time, students who have been trained using automated racetracks are exempted from taking the initial skills exam.

Innovations are strict not only in relation to driving schools and examined students. The introduced changes significantly increase the requirements for the examiners themselves. Yes, minimal age limit for an inspector taking an examination is now increased from the current 23 to 25 years. In addition, from now on, the inspector is required to have a higher education, although at present, secondary education is also acceptable.

It should be noted that the new law, as noted above, comes into force on November 5, 2013. This government decree is only the first by-law that will make it possible to implement the innovations laid down in the law.

In particular, today there is no program for training drivers in accordance with the requirements put forward by law. In fact, it turns out that driving schools do not yet know how they will train students who will have to take exams for obtaining “licenses” after November 5th. At the same time, the departments themselves currently cannot agree among themselves on the training of future drivers.

So, earlier the Ministry of Education was engaged in the development of curricula for passing exams for categories "A" and "B". Russian Federation. However, as early as September 1 this year, a new edition of the Law “On Education” will come into force, according to which the training of future drivers is classified as professional training.

The programs are developed by the Ministry of Transport. At the same time, the agency is already ready to present programs for categories "C" and "D", as well as subcategories. However, it is still not clear what to do with the most popular category "B". It is these questions that are most relevant today, and there are no answers to them yet.

I. General provisions

Subject of regulation

1. Administrative regulations of the Ministry of Internal Affairs of the Russian Federation for the provision of public services for conducting exams for the right to drive vehicles and issuance of driver's licenses 1 determines the timing and sequence of administrative procedures (actions) related to the examinations for the right to drive vehicles of the relevant categories and their subcategories 2, provided for in paragraph 1 of Article 25 of the Federal Law of December 10, 1995 N 196- Federal Law "On Road Safety" 3 , the issuance of Russian national and international driving licenses 4 and the exchange of foreign national and international driving licenses for Russian national and international driving licenses 5 by divisions of the State Road Traffic Safety Inspectorate of the Ministry of Internal Affairs of the Russian Federation 6 .

Circle of applicants

2. Applicants are natural persons permanently or temporarily residing or temporarily staying on the territory of the Russian Federation who applied for the provision of a public service 7 .

Requirements for the procedure for informing about the provision of public services

3. Informing on the provision of public services is carried out:

3.1. In the information and telecommunications network "Internet" 8 using the federal state information system "Unified portal of state and municipal services (functions)" 9 (www.gosuslugi.ru), on the official website of the Ministry of Internal Affairs of the Russian Federation 10 (www.mvd.ru ) and its territorial bodies at the regional level, on the official website of the State traffic inspectorate (www.gibdd.ru).

3.2. Through publication in the media, publication of information materials (brochures and booklets).

3.3. Using information stands and (or) electronic displays with visual, textual and multimedia information in places where public services are provided.

3.4. Using means of telephone and facsimile communication, e-mail.

3.5. Officials of the State Traffic Inspectorate, who, in accordance with the official regulations (job descriptions), are responsible for the implementation of administrative procedures (actions) for the provision of public services 11 .

4. Information on the provision of public services includes the following information:

4.1. Information about the location, postal address, contact numbers (telephones for information), the operating hours of the traffic police departments, indicating the categories and subcategories of vehicles for the right to drive which these departments conduct relevant exams, as well as the possibility of obtaining international driver's licenses.

4.2. Names of normative legal acts regulating the provision of public services, indicating their details.

4.3. The procedure for the provision of public services.

4.4. The list of documents submitted by the applicant, depending on the purpose of providing public services.

4.5. The form and sample of filling out the application, which must be submitted to the applicant in order to receive public services.

4.6. The size of the state fee for the provision of public services, as well as details for its payment.

4.7. Electronic addresses on the Internet of the official website of the Ministry of Internal Affairs of Russia, the official website of the State Traffic Inspectorate and the Single Portal.

4.8. Information about the routes used for the examination in driving in traffic conditions 12 .

4.9. A list of places for conducting exams and schedules for their conduct, indicating the addresses, categories and subcategories of vehicles for the right to drive which the corresponding exams are held in these places.

4.10. Set of examination problems 13 .

4.11. The procedure for pre-trial (out-of-court) appeal by the applicant of decisions and actions (inaction) of officials of examination units in the provision of public services.

5.6. Helplines.

6. Consultations are provided by officials upon personal or written application of the interested person through the official website, telephone or e-mail.

7. General advice (on location, work schedule and required documents) can be provided using auto-information tools. With auto-informing, round-the-clock provision of background information is provided.

8. Consultations are provided on the following issues:

8.1. About the location, postal address, contact numbers, working hours of the examination department, categories and subcategories of vehicles for the right to drive which this department conducts relevant exams, about the possibility of obtaining international driver's licenses.

8.2. On the list of documents required for the provision of public services.

8.3. On the requirements for documents necessary for the provision of public services.

8.4. On the amount of state duty.

8.5. On the term of the provision of public services.

8.6. On the procedure for appealing decisions and actions (inaction) of officials of examination units in the provision of public services.

9. The duration of the oral consultation of the person concerned may not exceed 15 minutes.

10. If it takes a long time to give an answer, the official providing individual oral consultations may offer interested persons to apply for the necessary information in writing or appoint another time convenient for interested persons for oral consultations.

All consultations are provided free of charge.

11. The answer to a phone call should begin with a message about the name of the examination unit, position, surname of the official who received the phone call.

Talk time, as a rule, should not exceed 5 minutes.

If the official who received the call cannot answer the questions on his own, the phone call must be redirected (transferred) to another official or the applicant must be given a telephone number where the necessary information can be obtained.

II. Public Service Standard

Name of the public service

12. State service for conducting examinations for the right to drive vehicles and issuing driver's licenses.

Name of the federal executive body and its structural subdivisions directly providing the public service

13. Public service is provided by the Ministry of Internal Affairs of Russia.

The public service is provided by the Special Purpose Center for Road Safety of the Ministry of Internal Affairs of the Russian Federation 15 ; subdivisions of the State traffic inspectorate of the territorial bodies of the Ministry of Internal Affairs of Russia for the constituent entities of the Russian Federation 16 ; subdivisions of the State traffic inspectorate of departments, departments, departments of the Ministry of Internal Affairs of Russia for regions, cities and other municipalities, including several municipalities, for closed administrative-territorial entities, subdivisions of the State traffic inspectorate of the Administration of the Ministry of Internal Affairs of Russia at the Baikonur complex 17 , which are entrusted with duties for conducting examinations, issuing driving licenses and exchanging foreign driving licenses 18 .

14. The public service is provided by the examination departments at the place of application of the applicant.

In the absence of the possibility of conducting examinations for the right to drive vehicles of certain categories or subcategories and (or) issuing international driver's licenses in the examination unit at the place of application of the applicant, these administrative procedures (actions) are carried out in examination units that have the ability to carry them out 19 .

15. When providing a public service, it is prohibited to require the applicant to take actions, including approvals, necessary for obtaining state and municipal services and related to applying to other state bodies, local governments, organizations, with the exception of receiving services and obtaining documents and information, provided as a result of the provision of such services included in the lists specified in Part 1 of Article 9 of the Federal Law of July 27, 2010 N 210-FZ "On the organization of the provision of state and municipal services" 20 .

Description of the result of the provision of public services

16. The result of the provision of a public service is the issuance of a driver's license or the refusal to conduct examinations and (or) the issuance of a driver's license.

17. The term for the provision of public services from the date of receipt and registration of the application and documents required for the provision of public services, until the issuance of a driver's license, subject to the applicant's consistent and successful completion of all procedures established by the Administrative Regulations, should not exceed:

17.1. In the case of issuing a Russian national driver's license for the right to drive vehicles of categories "A", "M" or subcategories "A1", "B1" - 15 working days.

17.2. In case of issuance of a Russian national driving license for the right to drive vehicles of categories "B", "C", "D", "BE", "CE" and "DE" or subcategories "C1", "D1", "C1E" and "D1E" - 30 working days.

17.3. In the case of issuing a Russian national driver's license for the right to drive vehicles of category "Tm" or "Tb" - 5 working days.

17.4. In case of issuing a Russian national driving license instead of a previously issued Russian national driving license, issuing an international driving license or exchanging a foreign driving license to employees of diplomatic missions and consular offices of foreign states in the Russian Federation and their family members, employees of international organizations and their representative offices accredited with the Ministry Foreign Affairs of the Russian Federation 21 , and their family members who have diplomatic, consular, service cards or certificates issued by the Russian Ministry of Foreign Affairs 22 - 1 hour.

18. The term for the provision of a public service does not include the time spent on transitions (transfers) to the places of administrative procedures provided for by the Administrative Regulations.

19. If there are grounds for suspending the provision of a public service in accordance with paragraph 28 of the Administrative Regulations, the public service shall be suspended until the reason for the suspension is eliminated.

20. The provision of public services is carried out in accordance with:

20.1. Civil Code of the Russian Federation (part one) 23 .

20.2. Tax Code of the Russian Federation (part two) 24 .

20.3. Federal Law of December 10, 1995 N 196-FZ "On Road Safety".

20.4. Federal Law of July 27, 2010 N210-FZ "On the organization of the provision of state and municipal services".

20.6. Decree of the President of the Russian Federation of June 15, 1998 N 711 "On additional measures to ensure road safety" 26 .

20.7. Decree of the Council of Ministers - the Government of the Russian Federation of October 23, 1993 N 1090 "On the Rules of the Road" 27 .

20.8. Decree of the Government of the Russian Federation of October 24, 2011 N 861 "On Federal State Information Systems Providing Electronic Provision of State and Municipal Services (Implementation of Functions)" 28 .

20.9. Decree of the Government of the Russian Federation of May 16, 2011 N 373 "On the development and approval of administrative regulations for the performance of state functions and administrative regulations for the provision of public services" 29 .

21. List of documents submitted by the applicants:

21.1. Application (the application form is given in Appendix No. 2 to the Administrative Regulations).

21.2. Passport or other identity document.

21.3. Medical conclusion on the presence (absence) of drivers of vehicles (candidates for drivers of vehicles) of medical contraindications, medical indications or medical restrictions on driving 34 - in case of passing exams, replacement of the Russian national driver's license due to its expiration or loss of grounds for the termination of the right to drive vehicles in connection with the identification as a result of a mandatory medical examination of medical contraindications or previously unidentified medical restrictions on driving vehicles, depending on their categories, purpose and design characteristics in accordance with paragraph 8 of the Rules for the return of a driver's license after the loss of grounds for termination of the right to drive vehicles, approved by Decree of the Government of the Russian Federation of November 14, 2014 N 1191.

21.4. A document confirming the completion of the relevant vocational training under the vocational training programs for drivers of vehicles of the relevant categories and subcategories, in case of passing exams after passing the relevant vocational training.

21.5. Russian national driver's license - if available.

21.6. International driving license - in case of replacement.

21.7. Foreign national driver's license - in case of its exchange.

21.8. Written consent of the legal representatives (parents, adoptive parents or guardians) of a minor candidate for drivers to pass an exam and issue a Russian national driver's license, certified in accordance with the legislation of the Russian Federation - in the case when the applicant is a person aged 16 to 18 years, for except for the case when a minor is declared fully capable (emancipation) or enters into marriage in the manner prescribed by the legislation of the Russian Federation 35 .

21.9. Diplomatic, consular, service cards or certificates issued by the Ministry of Foreign Affairs of Russia - in the case of the exchange of foreign driving licenses by employees of diplomatic missions and consular offices of foreign states in the Russian Federation and their family members, employees of international organizations and their representative offices accredited to the Russian Ministry of Foreign Affairs, and their members families.

21.10. Photo in color or black and white, on matte photo paper, size 35x45 mm - in case of issuing an international driver's license.

22. In the event that an application is sent to the State traffic inspectorate in electronic form using the information resources of the Ministry of Internal Affairs of Russia on the Internet or the Single Portal, the applicant fills out a formalized application form in electronic form indicating the necessary details of the documents specified in clause 21 of the Administrative Regulations, the originals of which are subsequently submitted to the examination subdivision.

An exhaustive list of documents required in accordance with regulatory legal acts for the provision of public services, which are at the disposal of state bodies, local governments and other bodies involved in the provision of state or municipal services, and which the applicant has the right to submit, as well as ways to obtain them by applicants , including in electronic form, the procedure for their submission

23. The applicant, on his own initiative, may submit a document confirming the payment of the state fee.

24. The fact of payment of the state fee by the payer is confirmed by the information on the payment of the state fee contained in the State Information System on State and Municipal Payments.

25. When providing a public service, officials are not entitled to demand from the applicant:

25.1. Submission of documents and information or implementation of actions, the submission or implementation of which is not provided for by regulatory legal acts regulating relations arising in connection with the provision of public services.

25.2. Presentation of documents and information that, in accordance with the regulatory legal acts of the Russian Federation, regulatory legal acts of the constituent entities of the Russian Federation and municipal legal acts, are at the disposal of state bodies providing public services, other state bodies, local governments and (or) subordinate to state bodies and to local government bodies of organizations participating in the provision of state or municipal services, with the exception of the documents specified in Part 6 of Article 7 of the Federal Law of July 27, 2010 N 210-FZ "On the organization of the provision of state and municipal services".

An exhaustive list of grounds for refusing to accept documents required for the provision of public services

26. The grounds for refusal to accept an application and documents required for the provision of public services are:

26.1. Lack of documents, the submission of which is provided for in paragraph 21 of the Administrative Regulations.

26.2. Submission of expired documents, with the exception of a driver's license.

26.3. The presence in the submitted documents of entries made in pencil or with erasures, additions, crossed out words, unspecified corrections, as well as the absence of the necessary information, signatures, seals in them.

An exhaustive list of grounds for suspension or refusal to provide a public service

27. The grounds for refusal to provide a public service are:

27.1. Appeal of an applicant who has not reached the age established by Article 26 of the Federal Law of December 10, 1995 N 196-FZ "On Road Safety" or who does not have a medical opinion on the absence of contraindications to driving vehicles or who has not completed appropriate professional training in the prescribed manner.

27.2. Appeal on the issuance of a driver's license, the exchange of a foreign driver's license of an applicant who has not reached the age established by Article 26 of the Federal Law of December 10, 1995 N 196-FZ "On Road Safety" or who does not have a medical certificate confirming the absence of contraindications to driving vehicles, or not passed in established cases the relevant exams provided for in paragraph 9 of the Rules.

27.3. Availability of information about the deprivation of the applicant's right to drive vehicles.

27.4. Submission of documents that do not meet the requirements of the legislation of the Russian Federation, as well as containing false information.

27.5. Presentation of documents that have signs of forgery, as well as those that are among the lost (stolen).

28. The grounds for suspension of the provision of public services are:

28.1. Failure to pay the state fee or lack of information about the payment. The public service is suspended until confirmation of the fact of payment of the state fee.

28.2. Missing by the applicant of the deadline set for the submission of documents when submitting an application in the form of an electronic document using the Single Portal.

The public service is suspended until the applicant's personal application to the examination department for the submission of documents provided for in paragraph 21 of the Administrative Regulations.

If the applicant fails to appear at the examination department to submit the necessary documents within six months from the date of submission and registration of the application in the form of an electronic document using the Single Portal, the provision of public services is terminated.

28.3. Absence of the applicant to the place of the examination.

The public service is suspended until the applicant's personal appeal to the examination unit, the official of which made the decision to appoint the exam.

If the applicant fails to appear at the examination department within six months from the date of appointment of the examination, the provision of public services is terminated.

29. In case of suspension of the provision of public services in accordance with subparagraph 28.1 or 28.2 of the Administrative Regulations, the applicant is sent a notice of suspension of the provision of public services, no later than one working day from the date of such a decision.

30. Services that are necessary and mandatory for the provision of public services, and documents issued by organizations participating in the provision of public services, are not provided for by regulatory legal acts.

The procedure, amount and grounds for the collection of state duty or other fees charged for the provision of public services

31. The state duty for the provision of public services is collected in the manner and in the amount established by subparagraphs 43 and 44 of paragraph 1 of Article 333.33 of the Tax Code of the Russian Federation.

The procedure, amount and grounds for charging fees for the provision of services that are necessary and mandatory for the provision of public services, including information on the methodology for calculating the amount of such fees

32. Payment for services that are necessary and mandatory for the provision of public services is not provided.

The maximum waiting time in the queue when submitting a request for the provision of a public service, a service provided by an organization participating in the provision of a public service, and upon receipt of the result of the provision of such services

33. The maximum waiting time in the queue when submitting an application and documents necessary for the provision of a public service or obtaining the result of the provision of such a service is 15 minutes.

The term and procedure for registering the applicant's request for the provision of a public service and a service provided by an organization participating in the provision of a public service, including in electronic form

34. The application can be filled out by hand, typewritten, using electronic printing devices, or generated in electronic form using the information resources of the Ministry of Internal Affairs of Russia on the Internet or the Single Portal.

35. A written application accepted for consideration is subject to registration within 15 minutes after its receipt. An application received in the form of an electronic document is subject to registration within the working day following the day the application was received.

36. An application for the provision of a public service with the attachment of documents in electronic form can be sent by the applicant using the information resources of the Ministry of Internal Affairs of Russia on the Internet or the Single Portal.

37. The application is accepted by an official during the entire time set by the schedule for the reception of citizens in the examination unit.

38. In case of non-appearance at the appointed time of the applicant who applied to the examination unit using the information resources of the Ministry of Internal Affairs of Russia on the Internet, through the Single Portal or using a preliminary appointment, the waiting period is 30 minutes, after which the reception of the specified applicant and the execution of documents are carried out in general order.

39. Registration of an application is carried out by entering the information specified in the application into information systems designed to ensure the activities of the departments of the State traffic inspectorate 36 .

Requirements for the premises in which the public service is provided, for the place of waiting and receiving applicants, for the placement and design of visual, textual and multimedia information on the procedure for providing the service

40. The premises for the reception of applicants are located, if possible, on the lower floors of buildings with a separate entrance.

41. Premises of officials must comply with the following requirements:

41.1. Availability of tables and chairs.

41.2. Having a phone.

41.3. Availability of computer and organizational equipment, as well as stationery.

41.4. Access to the main regulatory legal acts regulating the procedure for the provision of public services.

42. Places of waiting and receiving applicants must meet the following requirements:

42.1. Availability of tables and chairs.

42.2. Appropriate signage and signage.

42.3. Availability of writing paper and stationery.

43. Entrance to the premises and movement around the premises where citizens are received should not create difficulties for persons with disabilities, have accessible public places (toilets).

44. The entrance to the premises shall be equipped with a special ramp to ensure unimpeded access for persons with disabilities, including persons using special means for mobility (wheelchairs).

45. Tables intended for persons with disabilities are placed away from the entrance, taking into account the unimpeded access and rotation of wheelchairs.

46. ​​Parking spaces for applicants' vehicles, including those for vehicles of persons with disabilities, must be equipped within walking distance from the examination units.

47. In the parking lot of the applicants' vehicles, at least 10 per cent of the spaces (but not less than one space) are allocated for parking vehicles of persons with disabilities.

48. In the building in which the applicants are received, accessible places of public use (toilets) must be equipped.

49. The premises of the examination departments that consider more than 50 applications per day are equipped with a sound information system for applicants and electronic system queue management, which provides the possibility of performing administrative procedures (actions) in accordance with the assigned priority.

50. Applicants are provided with information about the officials who serve them. Information about the last name, first name, patronymic (the last - if any) and position must be placed on the personal identification card (badge) of the official and (or) on the information plate at the workplace.

51. The premises must comply with the requirements of fire, sanitary and epidemiological safety and be equipped with fire extinguishing and emergency warning equipment, an air conditioning system, and other means that ensure the safety and comfortable stay of applicants and officials.

52. The premises in which the theoretical exam is held are equipped with workplaces for candidate drivers and the examiner. The layout and equipment of the premises used for conducting the theoretical exam, the location of the examiner's workplace should ensure visual control over the actions of candidate drivers. In these premises, it is not allowed to use information materials, literature or technical means containing hints and facilitating the choice of the correct answers by the driver candidate.

53. In order to inform citizens about the possibility of their participation in the assessment of the quality of the provision of public services in the premises (waiting place) where the public service is provided, information materials are posted on the possibility of citizens' participation in the assessment of the quality of the provision of public services 37 .

Indicators of accessibility and quality of public service provision

54. Indicators of the availability and quality of the provision of public services are:

54.1. The timing of the public service.

54.2. Waiting time in the queue when receiving a public service.

54.3. The correctness and competence of the official interacting with the applicant in the provision of public services.

54.4. The comfort of the conditions in the premises in which the public service is provided.

54.5. Availability of information on the procedure for providing public services.

Other requirements, including those taking into account the specifics of the provision of public services in multifunctional centers for the provision of state and municipal services and the specifics of the provision of public services in electronic form

55. Applicants are provided with the opportunity to obtain information on the procedure for providing public services, as well as copying application forms on the official website of the State Traffic Inspectorate on the Internet and the Single Portal.

56. When sending an application and documents attached to it in electronic form, a simple electronic signature is used.

57. Public service in the multifunctional centers for the provision of state and municipal services is not provided.

III. Composition, sequence and deadlines for the implementation of administrative procedures (actions), requirements for the procedure for their implementation, including the specifics of the implementation of administrative procedures (actions) in electronic form

Exhaustive list of administrative procedures

58. The provision of a public service includes the following administrative procedures:

58.1. Acceptance and registration of the application and documents required for the provision of public services.

58.2. Formation and direction of interdepartmental request.

58.3. Conducting a theoretical exam.

58.4. Conducting an exam on initial driving skills.

58.5. Carrying out an exam on driving in traffic conditions.

58.6. Issuance of a driver's license.

58.7. Exchange of a foreign driver's license.

59. A block diagram of the provision of public services is given in Appendix No. 1 to the Administrative Regulations.

Acceptance and registration of the application and documents required for the provision of public services

60. The basis for starting the administrative procedure is the applicant's application to the examination unit with the application and attached documents necessary for the provision of public services.

61. An official establishes the identity of the applicant, checks the compliance of the information specified in the application with the submitted documents, the completeness and correctness of the documents.

62. The submitted documents are checked for compliance with the requirements of the legislation of the Russian Federation and for signs of forgery.

63. Foreign national and international driving licenses are checked for compliance with the requirements of international treaties of the Russian Federation.

64. If there are grounds provided for in paragraph 26 of the Administrative Regulations for refusing to accept an application and documents necessary for the provision of a public service, the applicant is invited to eliminate the identified shortcomings and re-submit the application.

65. The application sent by the applicant using the information resources of the Ministry of Internal Affairs of Russia on the Internet or the Single Portal, together with copies of the attached documents (if any), undergoes initial processing and verification of the information contained in it. The original documents, with the exception of the application, are submitted upon the applicant's personal application to the examination unit.

66. Based on the results of consideration of the application received in the form of an electronic document, an electronic message is sent to the applicant about the acceptance and registration of the application, or if at least one of the grounds provided for in paragraphs 26 or 27 of the Administrative Regulations is established, a notification is sent about the refusal to accept and register the application stating the reason for the refusal.

67. Information about the applicant is checked against the records of persons deprived of the right to drive vehicles.

68. The submitted driver's licenses are checked against the records of issued driver's licenses, distributed, lost, stolen, rejected special products of the State traffic inspectorate.

69. If there is no information on the issuance of a driver's license in the automated information system, a corresponding request is sent to the place of its issuance.

70. If it is necessary to verify the information contained in a foreign national or international driver's license, a request is sent to the relevant official or body of a foreign state to confirm the issuance of such a certificate.

71. If there are grounds for refusing to provide a public service in accordance with paragraph 27 of the Administrative Regulations, the applicant shall be sent an appropriate reasoned refusal in writing or delivered personally.

72. The fact that the applicant personally received a notice of refusal to provide public services is confirmed by his signature in the appropriate column of the application.

73. Information about the refusal to provide public services is entered into the information systems of the State traffic inspectorate.

74. The return of the state duty is carried out on the grounds and in the manner established by the Tax Code of the Russian Federation.

75. An official certifies the fact that the application form is properly filled out and the necessary documents are submitted by affixing his signature on the application indicating the surname and initials, the date and time of receipt of the application and documents.

76. The result of the implementation of the administrative procedure is the decision of the official to accept and register the application and documents necessary for the provision of the public service, or to refuse to accept and register the application and documents necessary for the provision of the public service.

Formation and direction of an interdepartmental request

77. In order to obtain information and documents necessary for the provision of public services, the official responsible for the preparation of documents independently requests such documents (information contained in them) by sending an interdepartmental request to the relevant federal executive authorities, public authorities of the subject of the Russian Federation Federations, local governments, an authorized organization or organizations subordinate to state bodies or local governments that issued such a document.

The direction of the interdepartmental request is carried out in electronic form through the system of interdepartmental electronic interaction 38 .

78. Sending an interdepartmental request in paper form is allowed only if it is impossible to send interdepartmental requests in electronic form due to confirmed technical unavailability or inoperability during the day of the services of the body to which the interdepartmental request is sent to the address registered in the SMEV or inoperability of the secure data transmission network or to bodies and organizations not registered with SMEV.

79. An interdepartmental request in paper form is filled in in accordance with the requirements of Article 7.2 of the Federal Law of July 27, 2010 N 210-FZ "On the organization of the provision of state and municipal services."

80. The results of inspections are noted in the application and certified by the signature of the official who conducted the inspection, indicating his last name and initials, the date and time of receipt of the results.

81. Answers to requests in paper form are attached to the application.

82. The result of the administrative procedure is the sending of an interdepartmental request.

The execution time of the administrative procedure is up to 15 minutes.

Conducting a theoretical exam

83. The basis for starting the administrative procedure for conducting a theoretical exam is the decision of an official on the admission of a candidate for drivers to pass a theoretical exam, adopted:

83.1. Based on the results of administrative procedures in accordance with paragraphs 60 - 75 of the Administrative Regulations.

83.2. According to the results of a previously held theoretical exam, for which the driver candidate received a negative assessment.

83.3. In the event of the expiration of 6 months from the date of the theoretical exam, for which the driver candidate received a positive assessment.

84. The administrative procedure for conducting a theoretical examination includes the following administrative actions:

84.1. Preparation for the theoretical exam - within a period not exceeding 20 minutes.

84.2. Conducting a theoretical exam - in a period not exceeding 30 minutes.

84.3. Determining and fixing the results of the theoretical exam - within a period not exceeding 10 minutes after the end of the exam.

85. When preparing for the exam by an authorized official, who, in accordance with the official regulations (job description), is assigned job responsibilities for examinations 39 , the identity of the driver candidate is established on the basis of the identity document presented by him, the candidate is familiarized with the procedure for conducting and the system for evaluating the results of the theoretical exam.

86. The examiner checks the operability of the automated system as a whole and each automated workplace 40 separately, if a malfunction is detected, the driver candidate is provided with another serviceable workstation.

Before the start of the exam, the monitor screen displays the number of the workstation, the name of the set of examination tickets for which the exam is conducted, as well as the last name, first name, patronymic (if any) of the driver candidate appointed to take the exam at this workstation.

87. During the exam, on the screen of the AWP monitor for driver candidates, ticket questions and the time remaining until the end of the exam are displayed.

To eliminate errors caused by accidental pressing of keys, the driver candidate must duplicate the answer chosen by him by pressing the corresponding key again or in another way determined by the technical capabilities of the equipment.

88. Information about the correctness of the answers to the questions of the ticket must be displayed on the workstation:

88.1. At the end of the time allotted for answering the questions of the ticket.

88.2. At the end of the time allotted for answering questions from additional thematic blocks in the cases provided for in paragraphs 98 and 99 of the Administrative Regulations.

88.3. After answering all the questions of the ticket and (or) answering the questions of additional thematic blocks in the cases provided for in paragraphs 98 and 99 of the Administrative Regulations.

88.4. After three incorrect answers to ticket questions.

88.5. After two incorrect answers to the questions of one thematic block of the ticket.

88.6. After one incorrect answer to the questions of additional thematic blocks in the cases provided for in paragraphs 98 and 99 of the Administrative Regulations.

89. Upon completion of the exam, the monitor screen displays the final grade for the exam, information about correct and incorrect answers, about providing the opportunity to answer questions from additional thematic blocks in the cases provided for in paragraphs 98 and 99 of the Administrative Regulations, as well as the time spent on the exam.

At the request of a driver candidate, the ticket questions for which an incorrect answer was selected are re-displayed on the monitor screen, indicating the correct answer.

90. Information about the answers to the questions of the tickets and the results of the exam for each driver candidate is formed on the monitor of the examiner's workstation for control, printing of the protocol of the exams and the examination sheet.

At the request of a driver candidate, after the exam is completed, the examiner displays comments on the answers to the ticket questions on the AWP monitor.

91. In the event that during the exam a malfunction of the workstation of a candidate driver is detected, the mark is canceled and the exam is conducted again at another workstation.

92. All examination questions are combined into 4 groups, consisting of thematic blocks. Each thematic block contains 5 questions. The ticket is formed from four thematic blocks, each of which is randomly selected from the corresponding group. Rearrangement of questions between thematic blocks is not allowed.

The exam ticket contains 20 questions. Each question has two to five possible answers, one of which is correct.

93. A driver candidate is given 20 minutes to answer the exam ticket. After the expiration of the specified time, the examination is terminated, except for the cases provided for in paragraphs 98 and 99 of the Administrative Regulations.

94. Timing of time is carried out automatically from the moment of displaying the AWP monitor for the driver candidate of the corresponding ticket.

The sequence of answers to the ticket questions is chosen by the driver candidate independently.

95. The exam is evaluated according to the following system: a positive mark - "PASSED", a negative one - "DID NOT PASS".

96. The result of the theoretical examination is considered positive and the driver candidate is given the mark "PASSED" if the driver candidate answered correctly in the allotted time:

96.1. For 20 ticket questions.

96.2. To all questions of additional thematic blocks in the cases provided for in paragraphs 98 and 99 of the Administrative Regulations.

97. The mark "DID NOT PASS" is given if the driver candidate:

97.1. In the allotted time, when answering questions, he made three mistakes.

97.2. In the allotted time, he made two mistakes in one thematic block or did not answer two questions in one thematic block.

97.3. In the allotted time, he made one mistake when answering questions from additional thematic blocks in the cases provided for in paragraphs 98 or 99 of the Administrative Regulations.

97.4. When answering the questions of the ticket, he used any literature, technical means or tips from other persons. At the same time, the exam is terminated, and the driver candidate is informed about it.

97.5. Left the exam (refused to answer the exam ticket).

98. If, when answering the questions of the ticket, the driver candidate made one mistake or did not answer one question in the allotted time, he is given the opportunity to answer 5 questions of one additional thematic block within 5 minutes. An additional thematic block is selected from the same group as the thematic block, when answering the questions of which the driver candidate made a mistake or did not answer.

If a driver candidate answered correctly 5 questions of an additional thematic block within the allotted time, he is given the mark "PASSED".

99. If, when answering the ticket questions, the driver candidate made two mistakes in different thematic blocks or did not answer two questions in different thematic blocks in the allotted time, or made one mistake and did not answer one question in different thematic blocks in the allotted time blocks, he is given the opportunity to answer 10 questions of two additional thematic blocks within 10 minutes. Additional thematic blocks are selected from the same groups as thematic blocks, when answering the questions of which the driver candidate made mistakes or did not give answers or made a mistake and did not give an answer.

If a driver candidate answers correctly to 10 questions of additional thematic blocks in the allotted time, he is given a mark of "PASSED".

100. The grades obtained by the driver candidate in the exam are entered in the examination sheet (Appendix No. 3 to the Administrative Regulations), which is signed by the examiner and the driver candidate.

101. A driver candidate who has shown an unsatisfactory result is explained the mistakes made, the procedure and terms for retaking the exam.

102. Based on the data on the results of the exam, the examiner or an authorized official enters the relevant information into the information systems of the State traffic inspectorate and the exam protocol (Appendix No. 6 to the Administrative Regulations).

The entered information is certified by a qualified electronic signature of an official.

103. The result of the administrative procedure is the examination by the examiner in the examination sheet of the grade obtained by the candidate driver in the theoretical exam.

Conducting an initial driving skills test

104. The basis for starting the administrative procedure for conducting an exam in basic driving skills is the decision of an official to admit a candidate for drivers to pass an exam in basic driving skills, adopted:

104.1. According to the results of the theoretical exam, for which the driver candidate received a positive assessment.

104.2. Based on the results of a previous test in basic driving skills, for which the driver candidate received a negative assessment.

105. The administrative procedure for conducting an initial driving skill test includes the following administrative steps:

105.1. Preparation for the exam on the initial skills of driving a vehicle - within a period not exceeding 20 minutes.

105.2. Carrying out test exercises for an exam on the initial skills of driving a vehicle - within a period not exceeding the standards established by Appendix No. 7 to the Administrative Regulations.

105.3. Determining and fixing the results of the exam on the initial skills of driving a vehicle - within a period not exceeding 10 minutes after the completion of the test exercises.

106. When preparing for the exam on the initial skills of driving a vehicle, the examiner checks:

106.1. Vehicle for compliance with the requirements for vehicles used for practical examinations, in accordance with Appendix No. 3 to the Rules.

106.2. Autodrome, automated autodrome, closed area for conducting an exam on the initial skills of driving a vehicle, means of audio and video recording of the process of conducting practical exams for compliance with the requirements for technical means control of knowledge and driving skills of candidates for drivers in accordance with Appendix No. 1 to the Rules.

106.3. The performance of audio and video recording of the process of conducting practical exams.

106.4. Compliance of the equipment of the areas for performing test exercises, their sizes with Appendix No. 7 to the Administrative Regulations.

107. The examiner establishes the identity of the candidate for drivers on the basis of the identity document presented by him, familiarizes the candidate for drivers with the procedure for conducting and the system for evaluating the results of the exam in the initial skills of driving a vehicle.

108. In the examination sheet (Appendix No. 4 to the Administrative Regulations), the examiner indicates the make, model, state registration plate, category (subcategory) and type of vehicle transmission.

109. At the command of the examiner, the candidate driver takes the driver's seat, prepares for the movement and begins to perform test exercises.

110. A driver candidate shall complete all the test exercises provided for conducting an exam for the right to drive a vehicle of the corresponding category or subcategory (Appendix No. 7 to the Administrative Regulations).

111. The examiner controls the progress of the test exercises, gives commands to the candidate driver, fixes errors in the examination sheet.

112. The grades obtained by the driver candidate in the exam are entered in the examination sheet, which is signed by the examiner and the driver candidate.

113. The mark "NOT PASSED" is given if the driver candidate:

113.1. Did not start the test exercise within 30 seconds after receiving the command (signal) to start its implementation.

113.2. Ran a wheel on the marking line marking the boundaries of the test exercise areas, or knocked down the marking equipment 3 or more times.

113.3. Left (crossed with a wheel) beyond the boundaries of the test exercise areas, indicated by road marking lines 1.1 white or 1.4 41 yellow and marking cones (marking posts) 42 .

113.4. Crossed the "STOP" line according to the projection of the front dimension of the vehicle in cases where a stop in front of the "STOP" line is provided for by the conditions of the test exercise.

113.5. Did not cross the control line with the external dimensions of the vehicle in cases where the crossing of the control line is provided for by the conditions for performing the test exercise.

113.6. Deviated from the given trajectory of movement, provided for by the conditions of the test exercise.

113.7. Allowed the engine to stop 3 or more times.

113.8. Stopped to the corresponding marking line at a distance exceeding the control value.

113.9. Carried out the movement in reverse in the event that reversing is not provided for by the conditions for performing the test exercise.

113.10. Exceeded total test exercise time.

113.11. When passing the exam for the right to drive vehicles of categories "M", "A" or subcategory "A1", he exceeded the time for performing the element of exercise N 1 "High-speed maneuvering".

113.12. When passing the exam for the right to drive vehicles of categories "M", "A" or subcategory "A1" he touched the surface of the site with his foot (feet) 3 or more times in cases where touching is not provided for by the conditions for performing the exercise or did not give a turn signal 2 or more times in cases when the supply of these signals is provided for by the conditions of the exercise.

113.13. When performing the exercise "Stopping and starting to move on the rise", he allowed the vehicle to roll back on the rise by more than 0.3 m.

113.14. When performing the exercise "Passing a regulated intersection", he passed the intersection (drifted to the intersection) or crossed the "STOP" line according to the projection of the front clearance of the vehicle with a prohibiting traffic light signal.

113.15. Left the exam (refused to perform the test exercise).

114. Upon completion of the exam, the actions provided for in paragraphs 101 and 102 of the Administrative Regulations are carried out.

115. Information obtained using audio and video recording tools for the process of conducting practical exams is transferred to an automated information system examination department.

116. The result of the administrative procedure is the examination by the examiner on the examination sheet of the score obtained by the candidate driver in the examination in the initial skills of driving a vehicle.

The total time to complete the administrative procedure in relation to one driver candidate is up to 1 hour.

Carrying out an exam on driving in traffic conditions

117. The basis for initiating the administrative procedure for conducting an exam in driving a vehicle in traffic conditions is the decision of an official on the admission of a candidate for drivers to pass an exam in driving a vehicle in road traffic, adopted:

117.1. Based on the results of an initial driving skills test for which the driver candidate received a positive assessment.

117.2. Based on the results of a previous driving test in traffic conditions, for which the driver candidate received a negative assessment.

117.3. According to the results of administrative procedures in accordance with paragraphs 60 - 75 of the Administrative Regulations in the case of a candidate for drivers who has successfully passed qualification exams to test theoretical knowledge and initial skills in driving vehicles of categories "B", "C", "D", "BE" , "CE" and "DE" and subcategories "C1", "D1", "C1E" and "D1E" in the organization carrying out educational activities, in accordance with the requirements of subparagraph "a" of paragraph 9 of the Rules.

118. The administrative procedure for conducting an exam in driving a vehicle in traffic conditions includes the following administrative actions:

118.1. Preparation for the exam on driving in traffic conditions - within a period not exceeding 20 minutes.

118.2. Carrying out an exam on driving a vehicle in traffic conditions - up to 30 minutes, provided that the candidate driver completes all maneuvers and actions on the route.

118.3. Determining and fixing the results of an exam in driving a vehicle in traffic conditions - within a period not exceeding 10 minutes after the end of the exam.

119. When preparing for an exam in driving a vehicle in traffic conditions, the examiner checks:

119.1. Vehicle for compliance with the requirements for vehicles used for practical examinations, in accordance with Appendix No. 3 to the Rules.

119.2. Means of audio and video recording of the process of conducting practical exams for compliance with the requirements for technical means of controlling the knowledge and driving skills of candidates for drivers in accordance with Appendix No. 1 to the Rules.

119.3. The efficiency of audio and video recording of the process of conducting practical exams.

120. The examiner establishes the identity of the candidate for drivers on the basis of the identity document presented by him, familiarizes the candidate for drivers with the procedure for conducting and the system for evaluating the results of the exam in driving a vehicle in traffic conditions.

121. In the examination sheet (Appendix N5 to the Administrative Regulations), the examiner indicates the route number, make, model, state registration plate, category (subcategory) and type of vehicle transmission.

122. During the examination, the candidate driver and the examiner are in the examination vehicle.

In the case of conducting an exam on a vehicle provided by an organization carrying out educational activities, a person teaching how to drive a vehicle may be on the seat from which access to the duplicate controls of the vehicle is made. In this case, the examiner is positioned in such a way as to be able to control the actions of the candidate driver and the person teaching how to drive the vehicle.

123. Before the start of the test, a person teaching driving a vehicle shall be checked for the availability of a document for the right to teach driving a vehicle of this category or subcategory, a driver's license for the right to drive a vehicle of the corresponding category or subcategory, and an insurance policy of compulsory third party liability insurance of vehicle owners.

124. Before the start of the exam, the examiner must ensure that the following conditions are met: the vehicle engine is warm and turned off, the gear lever is in the neutral position (for automatic transmission the transmission mode control is moved to the "P" position), the parking brake is applied, the means of audio and video recording of the process of conducting a practical exam are turned on.

125. At the examiner's command, the driver candidate takes the driver's seat, prepares for driving and starts driving along the route on which the exam is being conducted.

126. When driving along the route, the candidate driver, at the command of the examiner, performs the maneuvers and actions provided for in paragraph 2 of Appendix No. 2 to the Rules. The sequence of maneuvers and actions, including those related to changing the direction of movement along the route, is determined by the examiner during the exam.

127. If there are circumstances that prevent further movement along the route (traffic jam, repair and road works, a traffic accident, etc.), a deviation from the route is allowed with a subsequent return to it, or a decision is made to continue the exam on another route.

128. The examiner controls the progress of the maneuvers and actions provided for by the route, compliance with the Rules of the Road of the Russian Federation, gives commands to the candidate driver, evaluates his driving skills, the ability to control the traffic situation and make decisions if it changes, fixes errors in accordance with control table (Appendix No. 8 to the Administrative Regulations).

129. Errors are classified as gross, medium and minor. For each mistake, the driver candidate is awarded penalty points: for rough - 5, for medium - 3, for small - 1.

130. The result of the exam in driving a vehicle in traffic conditions is considered positive and the driver candidate is graded "PASSED" if the driver candidate did not make mistakes during the exam or the amount of penalty points for the mistakes made was less than 5 points.

In the event that the amount of penalty points for the mistakes made is 5 or more points, the driver candidate is given the mark "NOT PASSED", the exam is terminated.

131. The grades obtained by the driver candidate in the exam are entered in the examination sheet, which is signed by the examiner and the driver candidate.

132. Upon completion of the exam, the actions provided for in paragraphs 101 and 102 of the Administrative Regulations are carried out.

The information obtained using the means of audio and video recording of the process of conducting practical exams is transferred to the automated information system of the examination unit.

133. The result of the administrative procedure is the examination by the examiner on the examination sheet of the mark obtained by the candidate driver in the examination in driving in traffic conditions.

The total time to complete the administrative procedure in relation to one driver candidate is up to 1 hour.

Issuance of a driver's license

134. The grounds for starting an administrative procedure are:

134.1. The presence of a positive assessment received by the candidate for drivers based on the results of theoretical and practical exams.

134.2. The decision to issue an international driving license or to issue a Russian national driving license instead of a previously issued Russian national driving license, made by an official based on the results of consideration of documents in accordance with paragraphs 60 - 75 of the Administrative Regulations.

134.3. The decision to issue a driver's license in the event of loss of grounds for terminating the right to drive vehicles in connection with the identification, as a result of a mandatory medical examination, of medical contraindications or previously unidentified medical restrictions on driving vehicles, depending on their categories, purpose and design characteristics, taken by an official by a person based on the results of consideration of documents in accordance with paragraphs 60 - 75 of the Administrative Regulations.

135. The Russian national driving license, on the basis of which the international driving license was issued, is returned to its owner.

136. The issuance of a driver's license includes the following administrative steps:

136.1. Issuance of a driver's license.

136.2. Entering information into the information systems of the State traffic inspectorate and the register of issuing driver's licenses.

137. Driver's licenses are issued in accordance with the orders of the Ministry of Internal Affairs of Russia dated May 13, 2009 N365 "On the Entry into Force of a Driver's License" and dated April 18, 2011 No. N206 "On the Enactment of the International Driving Permit".

In the application, a note is made on the issuance of a driver's license, certified by the signature of the official who made the decision, indicating the last name and initials, the date and time of the decision. Obtaining a driver's license is certified by the signature of the applicant in the application.

141. The result of the administrative procedure is the issuance of a driver's license to the applicant or the refusal to issue a driver's license.

The execution time of the administrative procedure is up to 30 minutes.

Exchange of a foreign driver's license

142. The exchange of a foreign driver's license is carried out based on the results of the implementation of administrative procedures (actions) established by paragraphs 60 - 141 of the Administrative Regulations.

143. The foreign national driver's license, on the basis of which the Russian national driver's license was issued, shall be returned to its owner.

IV. Forms of control over the provision of public services

144. Current control over compliance with the procedure for the provision of public services, decision-making by officials of the examination departments is carried out constantly in the process of implementing the administrative procedures provided for by the Administrative Regulations, taking into account the timing of their implementation, as well as by conducting audits of the implementation of the provisions of the Administrative Regulations, other regulatory legal acts of the Russian Federation, regulating issues related to the provision of public services.

145. Current control is carried out by officials of the TsSN traffic police of the Ministry of Internal Affairs of Russia, divisions of the State traffic inspectorate at the federal, regional and district levels, heads of examination units, their deputies and other officials of the State traffic inspectorate responsible for organizing work to provide public services.

The procedure and frequency of scheduled and unscheduled inspections of the completeness and quality of the provision of public services, including the procedure and forms of control over the completeness and quality of the provision of public services

146. Quality control of the provision of a public service is carried out in the form of scheduled and unscheduled inspections of the completeness and quality of the performance of a public service.

When conducting a scheduled inspection, all issues related to the provision of public services (comprehensive inspections) or issues related to the execution of specific administrative procedures (thematic inspections) can be considered.

Scheduled and unscheduled inspections are carried out at least once a year. An unscheduled inspection may be carried out at the specific request of the applicant.

Scheduled and unscheduled inspections are carried out on the basis of orders from the head of the TsSN BDD of the Ministry of Internal Affairs of Russia, subdivisions of the State traffic inspectorate at the federal, regional or district levels.

Responsibility of officials of examination units for decisions and actions (inaction) taken (carried out) by them in the course of providing public services

147. In the event of violations of the provisions of the Administrative Regulations and other regulatory legal acts establishing the requirements for the provision of public services, authorized officials are liable in accordance with the legislation of the Russian Federation.

148. Interested citizens can control the provision of public services by obtaining information by phone, by written requests, by e-mail, through the official website of the State Traffic Inspectorate and the Ministry of Internal Affairs of Russia.

149. When providing the applicant with the result of a public service for issuing a driver’s license or refusing to conduct exams and (or) issuing a driver’s license, the official must inform him about the collection of citizens’ opinions on the quality of the public service provided, describe the assessment procedure 43 , draws the applicant’s attention that participation in the evaluation is free for him.

After a short description of the assessment procedure, the official invites the applicant to provide the subscriber number of the mobile radiotelephone communication device to participate in the assessment of the quality of the public service.

150. If the applicant refuses to assess the quality of the provision of public services using mobile radiotelephone communications, the official proposes to use a terminal or other device located directly at the place where the result of the public service is provided (if available) to participate in this assessment. technical capabilities) or evaluate the public service provided to him using the information and telecommunications network "Internet".

151. If the applicant agrees to participate in the assessment of the quality of the provision of public services using a mobile radiotelephone communication device, the subscriber number of the mobile radiotelephone communication device provided by the applicant, together with the contact details necessary to identify his opinion on the quality of the provision of public services, is transmitted by the information system of the State traffic inspectorate into the automated information system "Information and analytical system for monitoring the quality of public services".

V. Pre-trial (out-of-court) procedure for appealing against decisions and actions (inaction) of the federal executive body providing public services, as well as its officials

152. Applicants have the right to file a complaint against the decision and (or) action (inaction) of the examination unit and (or) its officials in the provision of public services 44 , including in the following cases:

152.1. Violation of the deadline for registration of the applicant's application for the provision of public services.

152.2. Violation of the term for the provision of public services.

152.3. The requirement for the applicant to submit documents that are not provided for by the regulatory legal acts of the Russian Federation for the provision of public services.

152.4. Refusal to accept documents, the submission of which is provided for by the regulatory legal acts of the Russian Federation for the provision of public services.

152.5. Refusal to provide a public service, if the grounds for refusal are not provided for by federal laws and other regulatory legal acts of the Russian Federation adopted in accordance with them.

153. The complaint must contain:

154. The complaint is considered by the examination unit providing a public service, the procedure for providing which was violated due to decisions and actions (inaction) of the examination unit or its official.

In the event that the decisions of the head of the examination unit providing the public service are appealed, the complaint is considered in the unit of the State traffic inspectorate at the regional level.

Complaints against decisions made by the head of the department of the State traffic inspectorate at the regional level are considered by the head of the department of the State traffic inspectorate at the federal level.

The procedure for filing and considering a complaint

155. The complaint is submitted in writing, including at the personal reception of the applicant, or electronically to the examination unit providing the public service, or to the unit of the State traffic inspectorate at the federal or regional level.

156. If the complaint is filed through the representative of the applicant, they are provided with a document confirming the authority to act on behalf of the applicant. A power of attorney issued in accordance with the legislation of the Russian Federation may be presented as a document confirming the authority to act on behalf of the applicant.

157. A written complaint may also be sent by mail.

158. If a complaint is filed at a personal reception, the applicant shall submit a document proving his identity, in accordance with the legislation of the Russian Federation.

160. When filing a complaint in electronic form, it must be signed with an electronic signature, the form of which is provided for by the legislation of the Russian Federation.

Terms of consideration of the complaint

161. A complaint received by the body authorized to consider it is subject to registration no later than the next working day from the date of its receipt.

The complaint is considered within 15 working days from the date of its registration, if shorter terms for consideration of the complaint are not established by the body authorized to consider it.

162. Satisfy the complaint, including in the form of cancellation of the decision, correction of misprints and errors in documents issued as a result of the provision of public services, return to the applicant of funds, the collection of which is not provided for by the regulatory legal acts of the Russian Federation, as well as in other forms.

164.2. Deny the complaint.

165. When a complaint is satisfied, exhaustive measures are taken to eliminate the identified violations, and the examination unit providing the public service, among other things, takes measures to issue the result of the public service to the applicant no later than 5 working days from the date of the decision, unless otherwise provided by the legislation of the Russian Federation.

The traffic police spoke about important innovations that will affect millions of Russians. From September, the rules for passing exams for rights and the procedure for obtaining a driver's license will change. The main provisions were approved by the government back in 2014, and during this time a lot of suggestions and comments were received from both citizens and driving schools. The Ministry of Internal Affairs took them into account and presented a new regulation.

“Give people another chance, if for some reason a person answered erroneously, incorrectly, he simply mechanically could press the wrong key. But if he is confident in himself, he will thereby confirm that he is ready,” explains the deputy head of the department organizational and methodological support of the registration and examination activities of the Main Directorate for ensuring road safety of the Ministry of Internal Affairs of Russia Sergey Fomochkin.

There is still one minute per question. But on the circuit now you don’t have to fit into a strict time frame. Instead of just a few minutes for each exercise, the examinee will now be able to spend as much as he needs.

“At the current stage, there is no need to chase after seconds, although, from our point of view, they were quite loyally built. Disputable points are also excluded from the new regulation. For example, a ban on being in the instructor's car.
