Penalty for stopping behind the stop prohibited sign (sign 3.27) in 2020

- 500 rubles. for the Russian Federation and 2500 r. for Moscow and St. Petersburg

Article of the Code of Administrative Offenses of the Russian Federation 12.19

Definition of "stop"

Stop - this is a deliberate (targeted) cessation of the movement of the vehicle for up to 5 minutes, and also for more, if necessary for boarding or disembarking passengers, or loading or unloading the vehicle.

In defining the concept of stop, two concepts (words) are important:

  1. "Intentional" - this concept tells us that braking to zero speed due to a breakdown, health problems and other extraneous reasons is not a stop and a fine issued to the driver in this case can be appealed.
  2. “Time up to 5 minutes” - from this piece of the definition it becomes clear that we are not talking about long-term storage of the car in one place, but about a short time period.

What does the stop prohibited sign (sign 3.27) prohibit?

The sign prohibits the vehicle from stopping behind it. The sign can be combined with other signs to indicate the time of the ban, the type of car that is prohibited from stopping in this place and sanctions (for example, the evacuation of the vehicle). As a rule, it is duplicated by yellow markings, which can be applied both on the roadway and on the curb.

No stop sign area

The sign is valid only on the side of the road on which it is installed. In the absence of other signs, valid 24/7 for all types of vehicles. Validity zone, without combination with other signs - until the next intersection (including the T-shaped one). If the sign is installed in a small settlement without intersections, the sign is valid on the territory of the entire settlement.

The combination of the stop sign is prohibited with other traffic rules

The stop sign is prohibited can be combined:

  • With the sign of the locality. In this case, the sign is valid either until the beginning of the settlement (sign of the beginning of the settlement), or until the end of the settlement (sign of the end of the settlement),
  • With the sign 3.31 (the sign of the end of restrictions) - before the sign, the end of all restrictions,
  • With sign 8.22 (distance sign) - stopping is prohibited from the sign and at the distance indicated on the sign,
  • With the sign 8.4.1-8.4.8 - stopping is prohibited for the type of vehicle indicated on the sign,
  • With the sign 8.18 - stopping is prohibited for everyone, except for vehicles for the disabled,
  • With the sign 8.2.4 - indicates the zone of validity of the sign,
  • With the sign 8.2.3 - indicates the end of the sign, stopping is prohibited.

What is the penalty for stopping under a No Stopping sign?

The penalty for stopping under the sign is regulated by article 12.19 of the Code of Administrative Offenses of the Russian Federation, part 1. "Violation of the rules of stopping or parking vehicles."

The penalty for stopping behind a No Stopping sign is as follows:

Fine for motorists in Russia 500 rubles.

Fine for motorists in Moscow and St. Petersburg 2500 rubles.

The fine for this violation can be paid on our website by entering your details in the form below and checking them. A 50% discount applies to a fine for stopping in the wrong place.

Recall that stopping the vehicle is prohibited not only under the stop is prohibited sign. Stopping is also prohibited:

  • at pedestrian crossings;
  • in the adjacent territories, where it will interfere with the passage of residents.
  • in parking lots for the disabled;
  • at public transport stops;
  • tram and railway tracks;
  • on sidewalks; on lawns; on playgrounds;

Many car enthusiasts do not have great patience. Often in big cities there are situations when there are no places where you can park. Then people start to stop their vehicles anywhere, thereby creating traffic jams and emergencies.

The designation "Stopping prohibited" has the number 3.27. What does he represent?

It is a red circle with a cross of the same color and a blue background. Do not confuse it with.

It looks the same as the one above, only it has only one red diagonal line.

Motorists should be aware of the sanctions that may apply to them in case of violation of the rules. This is written in article 12.19 of the Code "On Administrative Violations". So what is the fine for stopping under a No Stopping sign? At the time of 2018, there is a fine for parking in the wrong place in the amount of five hundred rubles.

However, other circumstances may also affect the punishment:

  1. If the driver commits this offense for the first time, then the inspector can only give a warning without penalty. This will help the violator to better understand that it is not worth neglecting the rules of the road.
  2. When the offense is committed in St. Petersburg or Moscow, the amount can rise to two and a half thousand rubles, but only on condition that the vehicle did not block the passage of other road users and pedestrians.
  3. If the vehicle (TC), which has remained in the wrong place, has become an obstacle for neighbors on the road, then in large provincial cities the fine will increase to two thousand, and in the capital to three. Often, such an action may entail the transportation of the vehicle by a tow truck to a penalty parking lot.

It is also worth remembering that the violator will pay for the operation of this service.

In the legislation, these concepts have differences, although they are insignificant. This means that the regulation of traffic will take place depending on these concepts.

Parking or parking is defined as the intentional stop of a vehicle, which lasts from fifteen minutes. Also in this concept there is no main purpose for parking, whether it is loading or unloading luggage, or boarding passengers. The period for parking a car is not limited by law.

Therefore, based on these interpretations, traffic rules consider different requirements for different situations. So, under the sign that prohibits parking, stopping is allowed, and under the sign “any stoppage of movement is a violation.

Obviously, in the most standard cases, stopping is prohibited under the appropriate sign with the number 3.27. However, it may have a limited period of validity. For example, stopping traffic in this place is prohibited from eight in the morning until nine in the evening, or the sign may imply a partial ban. So, only special vehicles can stop under it. If there is no such information, then the sign completely prohibits all vehicles from stopping.

Below is a list of places where stopping traffic is also prohibited:

  • in residential areas where such action would impede the passage of pedestrians;
  • decorative lawns;
  • playgrounds for children;
  • railway or tram tracks;
  • areas intended for the flow of pedestrians;
  • sidewalks;
  • stops made only for a certain type of transport, for example, public transport;
  • pedestrian crossings;
  • places reserved for .

In all situations, when a violation is recorded, the motorist will have administrative responsibility.

Citizens are informed about prohibited places for stopping at a driving school, however, some may simply forget this, and some prefer not to waste time looking for a suitable place and leave the vehicle where they want. This almost always entails a warning at best, and at worst a fine that the offender must pay within the specified time frame.

The question could also arise: stopping is prohibited exactly under the sign or within a certain radius. As a rule, the ban remains in force at a distance to the nearest road intersection, and if there is no other such sign, then it is already possible to stop driving. However, sometimes you can also find symbols with additional information about the range. When the edge of this radius is reached, the ban also does not apply.

Outside the outskirts of settlements, for example, a city, stopping a car is allowed if the sign was up to the border of the territory of the point. This rule also works in reverse.

Also, the designation remains valid only on one side of the road, that is, if there is no such sign on the lane with oncoming traffic, then you can stop there. So, if necessary, you can make a U-turn, if allowed, and calmly stop.

Additional information in the form of an arrow can also be set with the sign “Stopping is prohibited”. If it points up, then it is forbidden to stop moving behind the sign, if down, then in front of it, if in both directions, then the actions should be corresponding by analogy.

It happens that unforeseen circumstances occur that were not caused by the intentional actions of the motorist. Let's say there was a breakdown in the car and further movement seems impossible, and stopping at this place is prohibited by a sign.

In this case, the fine can be avoided if you make it clear to other road users about what happened. It is necessary to place appropriate signs that will warn near the car. Also, all concerns about safety measures and ensuring normal traffic on the roadway are assigned to the driver who had a breakdown.

In unforeseen circumstances, if the car breaks down and it is impossible to transport it to a place where stopping is prohibited, as well as in the case when there were no problems, but the visibility of the sign was rather poor, it is possible to legally avoid punishment.

To help you stand up for yourself:

  • video materials and photographs that clearly show a sign covered by an obstacle - a tree or a bush;
  • you can also use the testimony of eyewitnesses.

Therefore, you may not get punished if you use the emergency stop signal and set the appropriate icons.

Even if a police officer asks about the reason for the emergency parking, you should not talk about the deterioration of your condition, that is, about fatigue or illness, if this is not true. In this case, the inspector will call an ambulance, and if you refuse it, or the doctor does not find any signs of deterioration, then you can still be fined.

However, as before, the most guaranteed and best way to avoid a fine and other sanctions is to be attentive on the road, deliberate decisions and a plan of action in case of force majeure.

Sometimes it also happens that traffic police officers make mistakes and impose a fine on the driver without a visible violation, or they are required to pay two or more penalties for the same violation with a time difference of several hours. Then you can safely challenge such an illegal act.

First, we need evidence in the form of photos and videos. It is worth renting your car and there are no signs prohibiting parking or poor visibility. All evidence must be attached to the complaint.

  1. Complaint from you about the decision on an administrative offense.
  2. Application for consideration without your presence.
  3. If more than ten days have passed, a motion to reinstate the appeal period.
  4. Other possible evidence that will help defend your case and avoid punishment.

It is always worth remembering your rights, so that in case of illegal actions of a representative of the law, you can challenge his act.

The Code of Administrative Offenses says that if a vehicle parks in a place that is not allowed for this, then an exception from traffic is applied to it by transportation by a tow truck to a penalty parking lot. This is a specially designated protected area, and the violator's car will be there until the misdemeanor case is closed.

Below is a list of situations where a vehicle may be towed for improper parking:

  • organization of parking in the second row (that is, if there is a parking space on the roadway, and the driver parks not along the line of cars, but parallel to it, thereby forming a second row of parking);
  • parking on railway tracks and near them, if such action creates obstacles for other cars and railway transport;
  • long stop in the tunnel;
  • parking at a distance of less than three meters from a solid marking line or a dividing strip;
  • parking closer than five meters from the pedestrian crossing or directly on it;
  • less than fifteen meters from a public transport parking place; the reference point should be considered a special marking or a sign indicating this;
  • less than fifteen meters from the reference point indicating the parking lot, which is intended for passenger taxis;
  • a place where a long stop of a potential violator will make the passage of other vehicles impossible;
  • ; in this case, the fine can reach up to five thousand rubles;
  • stopping on a sidewalk or other place intended for the flow of pedestrians;
  • stop in violation of traffic rules in the presence of a nearby plate that informs about a working tow truck.

There are also a number of situations when it is impossible to take the car owner’s car to the impound lot:

  1. On the left side of the road.
  2. At a large angle to the road, that is, not parallel.
  3. Outside the city or other settlement.
  4. Fifty meters from railway and tram crossings.
  5. Parking near dangerous curves and road faults.
  6. At a junction or closer than five meters to the edge of the road that the driver is crossing.
  7. Long stop on the part intended for cyclists.
  8. Parking in violation of traffic rules, if there is no sign of a valid tow truck nearby.

As you can understand, the violator's car may not be evacuated in all cases. But this is not a reason to neglect the comfort of other road users.

Parking on site for the disabled

A badge on a car that indicates that a disabled person is driving still does not give the right to park in the appropriate place. This is allowed for people who have a disability certificate. So, if the inspector approaches the violator and asks for documents, but they are not found, then you will have to pay a considerable fine.

There are ways to deal with such violators.

If you have witnessed this situation and are not indifferent to it, you can call the inspectors and draw up a protocol or simply file a complaint. You can often encounter stubborn drivers who, day after day, park their car in the yard so that both passage and passage seem impossible.

Then you need to take a photo, but it is better to record a video, which will include all the circumstances under which the violation was committed and upload it to the state traffic police website.

With the increase in fines for most traffic violations, more and more car owners are becoming more cautious about driving and turning to one source or another to protect themselves from paying a serious fine.

In what cases is it prohibited to stop?

Cases when it is impossible to stop are described in detail in the SDA. First of all, the prohibition is regulated by the installation of a prohibition sign 3.27 with a temporary restriction (which must be indicated on an additional plate under the sign) or with a permanent effect. Also it is forbidden to stop the transport:

  • At pedestrian crossings.
  • On sidewalks and lawns.
  • At public transport stops.
  • In disabled parking spaces.
  • On railroad tracks or tram tracks.
  • Inside yards, interfering with the movement of residents and on playgrounds.

Violation of these seemingly simple rules will lead to an administrative penalty. It is worth remembering that the sign is duplicated by a solid yellow line on the curb or directly on the roadway.

Sign validity area 3.27

A prohibition sign is only valid on the side of the road on which it is placed. Also, each driver should be aware that the sign has its own zone, which ends under one of the following conditions:

  1. To the nearest intersection (in the absence of any additional signs).
  2. Before the beginning or end of the settlement (indicated on the plate under the sign).
  3. Until sign 3.31, indicating the end of the zone of all restrictions.
  4. If there is an indication of the exact distance on the additional plate, then the coverage area begins at the place where the sign is installed and ends after the number of meters or kilometers indicated on it.

Exceptions to the rules and nuances

Under the sign prohibiting parking, other additional signs are often installed, designed to regulate other parking rules:

  • It may indicate the type of vehicle (motorcycle, passenger car, truck, etc.) that is prohibited from stopping in the ban area. In this case, the ban applies only to this type of vehicle. Plates 8.4.1–8.4.8.
  • Additional plate 8.18 indicates that only disabled vehicles have the right to stop in the area of the sign.
  • Plate 8.2.3 means the end of the prohibition zone, and plate 8.2.4 indicates that the car is in the prohibition zone.

It is also worth noting that there are good reasons for stopping in the wrong place, when a violation cannot be recorded by a traffic police officer. These include:

  1. The occurrence of a breakdown in the brake system.
  2. The occurrence of a malfunction in the steering device.
  3. Malfunctions in the lighting system and marker lights.
  4. Urgent repair of the windshield wiper system in rainy and snowy weather.

These cases are not accidental: when they occur, driving is extremely dangerous.

You can also stop directly in front of the established sign or if the sign is not visible due to an overgrown tree, for example.

Punishment for stopping under a prohibition sign

Most of all, drivers are not worried about the fact of administrative responsibility, but the size of the fine. All rules are regulated by the Code of Administrative Offenses of the Russian Federation and differ depending on the severity of the offense:

  • If the rules are violated, but the stopped vehicle does not interfere with other road users, the fine will be 500 rubles.
  • If the stop was made on the sidewalk, behind the stop line, at a public transport stop or at a pedestrian crossing, the fine is twice as high - 1000 rubles.
  • In cases where the car was stopped on the railway tracks, the fine will be 1,500 rubles.
  • Stopping directly at the parking lot for the disabled will entail a fine of 3,000 - 5,000 rubles.

It is worth remembering that in some cases, traffic police officers have the right to send a vehicle to a penalty parking lot.

For Moscow and St. Petersburg, the penalties are slightly different:

  1. For stopping in the wrong place, provided that the car does not create interference, a fine of 1,500 rubles is imposed.
  2. Stopping on the sidewalk, as well as at a pedestrian crossing or public transport stop will result in a fine of 3,000 rubles. The car will be towed.

In what cases can punishment be avoided?

Avoiding punishment is quite difficult, and you will need to prove to the inspector that the sign was not in sight, which rarely happens. Most often, in order to avoid punishment, you just need to carefully follow the signs and markings, follow the rules and respect other road users.

In 2019, as before, there is a fine for stopping under the “No Stopping” sign. Its size remains the same, but there are situations in which administrative liability can be avoided. To understand this issue, it is enough to study it in more detail.

Area of action of the sign "Stopping prohibited"

No Stopping sign, circular, with crossed red lines on a blue background. It is usually installed on emergency sections of the road, but it can also be found in the following places:

  • Highways. It is allowed to drive at a speed of 110 km / h, but many drivers exceed the permissible 20 km / h, at which a fine is not issued. If the car will stand on such a road with high-speed traffic, this significantly increases the likelihood of an accident: other drivers may not react to a standing vehicle, especially if an emergency stop sign is not installed behind it;
  • Narrow roads in settlements. Two options are possible here: stopping is prohibited for all types of transport, or only for trucks. If you violate the ban and leave the car on such a road, the driver will create obstacles for other road users, because. they will have to go around his car, leaving the oncoming lane;
  • and on the roads where they are laid. Cars standing on such sections will interfere with the movement of trams and other drivers, provoking a traffic jam or an accident;
  • At road junctions or intersections. Stopping here is prohibited by traffic rules in any situation.

The sign "Stop is prohibited" is established at the initiative of the traffic police together with authorized representatives of the municipality. It is valid only on the side of the carriageway on which it is located. The range is to the nearest intersection or road intersection. If it is installed in a small village without intersections, the restrictions apply throughout the village.

The designation of the sign "Stopping prohibited" in combination with others

The above sign can be set together with others, which slightly changes its meaning:

  • With a sign indicating the beginning or end of the settlement. If it stands together with the sign of the beginning, it will act until the end. If the sign is installed together with the designation of the end of the village or city, the restrictions apply to the next settlement;
  • With the sign of the end of all restrictions (3.31). In such a situation, stopping restrictions apply to the section of the road where sign 3.31 will be located;
  • "Except for the disabled" (8.18). Everything is clear here: if a stop prohibition sign is installed together with 8.18, this means that the restrictions apply to everyone except citizens with disabilities;
  • Distance sign 22. If there is such a sign next to the “No Stopping” sign, this means that you cannot stop from the place of its installation and within a radius of a certain number of meters;
  • Together with the sign of a truck. Here, the meaning is very simple to interpret: such a combination signals a ban on stopping trucks before the first intersection or the abolition of all restrictions.

The amount of the fine for stopping under the sign "Stopping is prohibited"

Sanctions for violation of the requirements of traffic signs are determined by Art. 12.19 Administrative Code of the Russian Federation. Violators in Moscow and St. Petersburg will have to pay 2,500 rubles. For drivers from other regions, the fine is lower - only 500 rubles.

Car owners can be fined in two ways: if the inspector sees the violation personally, or when the violation is recorded by special devices (for example, PTZ cameras). Another option is also possible - sending other citizens a photo with the offender through electronic services to the traffic police.
