Order of the Ministry of Health and Social Development of Russia dated May 2, 2012 No. 441n approved the Procedure for issuing certificates and medical reports by medical organizations (hereinafter referred to as the Procedure), which came into force on June 17, 2012. To whom and by whom are medical certificates and reports issued?

Previously, the general procedure for issuing medical certificates and medical reports was not approved by the Ministry of Health of Russia and the Ministry of Health and Social Development of Russia. At various times, these departments have approved and currently operate separate forms of medical certificates and medical reports, as well as the procedure for their issuance. For example, Order No. 831n of the Ministry of Health and Social Development of Russia dated September 28, 2010 approved a single sample of a Medical Certificate of Admission to Driving Vehicles and instructions for filling it out.

In this regard, clause 19 of the Procedure contains a rule according to which the Procedure does not apply if the legislation of the Russian Federation establishes a different procedure for issuing a certificate or medical report or another form of a certificate or medical report.

The procedure establishes the rules for issuing two types of documents by medical organizations: certificates and medical reports. In order to receive one of these documents, you must personally contact a medical organization and present an identification document. Since medical certificates and medical reports can be issued to various categories of citizens located on the territory of Russia, the identity document depends on the status of the citizens (clause 2 of the Procedure):

  • for foreign citizens permanently residing in the Russian Federation, - a passport of a foreign citizen or another document established by federal law or recognized in accordance with an international treaty of the Russian Federation as an identification document of a foreign citizen;
  • for stateless persons permanently residing in the Russian Federation, - a document recognized in accordance with an international treaty of the Russian Federation as a document certifying the identity of a stateless person;
  • for foreign citizens temporarily residing in the Russian Federation, - a passport of a foreign citizen or another document established by federal law or recognized in accordance with an international treaty of the Russian Federation as an identification document of a foreign citizen, with a note indicating a temporary residence permit in the Russian Federation;
  • for stateless persons temporarily residing in the Russian Federation, - a document recognized in accordance with an international treaty of the Russian Federation as an identification document of a stateless person, with a note indicating a temporary residence permit in the Russian Federation, or a document of the established form issued in the Russian Federation to a stateless person who does not have an identification document his personality.

If you need to obtain a certificate or medical opinion regarding minors or incompetent persons, then to receive it, their legal representatives must contact the medical organization and present a document proving their identity, as well as a document confirming the authority of the legal representative (clause 3 of the Procedure). For example, the legal representatives of minors are parents, adoptive parents, guardians (trustees) (Articles 26, 28 of the Civil Code of the Russian Federation, Article 64 of the Family Code of the Russian Federation).

In some cases, medical reports are issued without the consent of the citizen or his legal representative to bodies, organizations, and the court that have the right to receive information about the fact that the citizen applied for medical care, his state of health and diagnosis, other information obtained during his medical examination and treatment, which constitute medical confidentiality(Clause 5 of the Procedure). Such cases are provided for in Part 4 of Art. 13 of Federal Law No. 323-FZ of November 21, 2011 “On the fundamentals of protecting the health of citizens in the Russian Federation” (as amended on June 25, 2012) (hereinafter referred to as Federal Law No. 323-FZ). These include:

1) conducting a medical examination and treatment of a citizen who, as a result of his condition, is unable to express his will;

2) the threat of the spread of infectious diseases, mass poisonings and injuries;

3) the presence of a request from the bodies of inquiry and investigation, the court in connection with an investigation or trial, at the request of a body of the penal system in connection with the execution of a criminal penalty and monitoring the behavior of a conditionally convicted person; a convicted person in respect of whom the serving of a sentence has been deferred, and a person released on parole;

4) providing medical assistance to a minor to inform one of his parents or other legal representative;

5) in order to inform internal affairs bodies about the admission of a patient in respect of whom there are reasonable grounds to believe that harm to his health was caused as a result of illegal actions;

6) for the purpose of conducting a military medical examination at the request of military commissariats, personnel services and military medical (medical flight) commissions of federal executive authorities, in which federal law provides for military and equivalent service;

7) for the purpose of investigating an industrial accident and occupational disease;

8) when exchanging information by medical organizations, including those posted in medical information systems, for the purpose of providing medical care, taking into account the requirements of the legislation of the Russian Federation on personal data;

9) for the purpose of accounting and control in the compulsory social insurance system;

10) in order to monitor the quality and safety of medical activities in accordance with Federal Law No. 323-FZ.

In the event of the death of a citizen, a medical report on the cause of death and diagnosis of the disease is issued to the following persons or government bodies:

  • spouse or close relative (children, parents, adopted children, adoptive parents, siblings, grandchildren, grandparents), and in their absence, other relatives or the legal representative of the deceased;
  • law enforcement agencies;
  • the body exercising state control over the quality and safety of medical activities, and the body exercising control over the quality and conditions for the provision of medical care, at their request (clause 6 of the Procedure).

As a general rule with corrections issued by the attending physician or other medical specialists who are directly involved in the medical examination and treatment of a citizen, based on entries in the citizen’s medical documentation or based on the results of a medical examination in cases where such an examination is necessary (clause 7 of the Procedure).   • about preventive vaccinations given to the citizen;
  • about the presence (absence) of contact with patients with infectious diseases;
  • on the release of the donor from work on the day of donation of blood and its components, as well as on the day of the associated medical examination (Part 1 of Article 186 of the Labor Code of the Russian Federation);
  • other information related to the patient’s health status and the provision of medical care to the citizen in a medical organization (clause 9 of the Procedure).

Medical reports are issued to citizens based on the results of medical examinations, medical examinations, medical examinations, decisions made by a medical commission, as well as in other cases when the legislation of the Russian Federation provides for the availability of a medical report (clause 12 of the Procedure).

Medical reports are issued on the basis of a medical examination of a citizen (including a commission) and contain a comprehensive assessment of the citizen’s health status, including:

  • assessment of the validity and effectiveness of diagnostic and treatment measures, including the prescription of medications;
  • justified conclusions: 1) about the presence (absence) of a citizen of a disease (condition), risk factors for the development of diseases; 2) on the presence of medical indications or medical contraindications for the use of methods of medical examination and (or) treatment, sanatorium treatment, implementation of certain types of activities, studies; 3) about the compliance of the employee’s health status with the work assigned to him, the student’s compliance with training requirements; 4) about the cause of death and diagnosis of the disease, including the results of a pathological autopsy;
  • other information relating to the citizen’s health status and the provision of medical care to him (clause 13 of the Procedure).
